Have state guardians been consulted on contraceptive administration to minors?

The Scottish Government’s unconsulted decision to appoint state Guardians for every Scottish child from birth to a prolonged majority is now under formal legal challenge.

Local authorities were permitted to go ahead and appoint such Guardians despite ministerial assurances to the Scottish parliament that this would not happen without further negotiation.

Today’s popular media is aghast that several Scottish local authorities have now allowed  over 3,000 children under the age of 16 – with some as young as 12 years of age – to be given contraceptive implants, involving the insertion of plastic Nexplanon implants with a lifespan of three years, under the skin on the arm.

There are two triggers for serious concern here:

  • Nexplanon itself admits that the safety of the drug used in under 16 year olds cannot be assured because it has not been established.
  • Parents of some of the children, even the youngest, were not consulted in the decision-taking around fitting these implants to their children.

It confounds reason and proper practice that local authorities – who employ the state Guardians they appoint for each child in their area and with an authority that supercedes that of the natural parents – have felt it acceptable to go ahead with a procedure whose impact on the health and wellbeing of young children is not known.

This situation involves issues amongst the most philosophically complex our society has to confront:

  • of the sexual exploitation of vulnerable young people, including those in possession of  runaway libidos they cannot understand or govern;
  • of the impact of unwanted pregnancies upon the lives of very young children; and of unwanted children born into unpredictable and often unable circumstances;
  • of the conflicted human rights of the young child, of the child that might be and of the parents of the child who remain in ignorance of the sexual activity of their child and of the physical and medical measures taken by others without their knowledge to prevent that activity leading to pregnancy.

Since the known volume of at least well over 3,000 implantations has run since 2010, it would be important toknow whegtehr, since their appointments, the state Guardians for these children were consulted on the use of the chemically preventative process where parents were not.

It would also be interesting to know if they were all actually informed that the process had been deployed.

The local authorities cited as having had such implants fitted in minors since 2010 are:

  • Ayrshire and Arran;
  • Grampian;
  • Greater Glasgow & Clyde
  • Lanarkshire;
  • Scottish Borders.

Other councils are known to have had this procedure carried out in minors but have refused to comment.
